PROBLEMATIKA MEMINIMALISASI NIKAH SIRI MELALUI NIKAH MASSAL MENURUT PENGALAMAN PENGADILAN AGAMA KOTA PONTIANAK DAN KANTOR URUSAN AGAMA KECAMATAN PONTIANAK TENGGARA

Abstract

This research aims to find out: 1) To examine the process of Mass Marriage Validation (Isbat Nikah Massal) in Pontianak City, involving the Class 1-A Religious Court of Pontianak City and the Southeast Pontianak Sub-district Office of Religious Affairs (KUA). 2) To determine whether Mass Marriage Validation has minimized unregistered marriages (Nikah Siri) according to the experiences of the Class 1-A Religious Court of Pontianak City and the Southeast Pontianak Sub-district KUA. This research employs a qualitative method with field research as the approach. Data collection techniques include interviews and documentation, with primary data sources from interviewees and secondary data from related references. The data analysis techniques involve data reduction, data presentation, and conclusion drawing, with the research location being in the Southeast Pontianak Sub-district. The research findings are: 1) The process of Mass Marriage Validation begins with the Southeast Pontianak KUA and the local sub-district office informing the public who do not yet have a marriage certificate to complete the necessary documents, register the application at the Pontianak Religious Court, then attend the Mass Marriage Validation session. After that, the married couples can immediately obtain a copy of the decree and proceed to obtain the marriage certificate and the child’s birth certificate. 2) Mass Marriage Validation has proven ineffective in reducing the number of unregistered marriages in Pontianak City, as it fails to meet the five factors influencing law enforcement. These five factors, namely legal regulations, law enforcement officers, infrastructure or facilities, society, and culture, have not yet successfully integrated the Mass Marriage Validation process to minimize unregistered marriages and achieve the desired outcomes.
