Abstract

This research aims to analyze the phenomenon of silent divorce that occurs when husband and wife are still legally bound, but communication, emotional closeness, and togetherness have weakened over a long period, as well as to analyze its status based on Islamic law and the resolutions that can be pursued. This research uses a qualitative approach with an empirical juridical type of research through a conceptual approach and a case approach. Data were obtained through interviews with three couples who experienced silent divorce and literature study. The research results show that silent divorce occurs in marriages that have lasted about 10–20 years, with the condition persisting for 5–12 years. These conditions are marked by weak communication, loss of emotional closeness, reduced togetherness, and the decision to maintain the marriage for the sake of the children. This phenomenon causes loneliness and emotional pressure on the couple and affects the child. In the perspective of Islamic law, silent divorce does not have its own legal status, so its assessment is based on the actions of each partner and the fulfillment of rights and obligations. This condition also indicates a neglect of rights and obligations within the household, while simultaneously showing that the marital relationship is not functioning as intended in marriage. If the estrangement leads to the neglect of rights and duties and causes harm, then such actions may be considered forbidden in Islam, as they contradict the principle of mu’asyarah bil ma’ruf, while conditions that have not yet reached that level can be viewed as makruh actions. A prolonged rift indicates characteristics that lead to syiqaq. Resolution is directed through reconciliation (ishlah), and if reconciliation efforts fail, then divorce becomes the last resort.
