ANALISIS PUTUSAN HAKIM PENGADILAN AGAMA PONTIANAK NOMOR 142/PDT.P/2022/PA.PTK TENTANG DISPENSASI NIKAH

Abstract

This study aims describe the legal basis of  the  judge  in  deciding  case  number  142/Pdt.P/2022/Pa.Ptk.  and to describe the judge's consideration in granting the application for marriage dispensation in decision document number 142/Pdt.P/2022/Pa.Ptk. The  method  used  in  this  research  is  qualitative  with  the  type  of  normative  legal  research.  Data  collection  techniques  are  done  by  documentation  and  literature.  Primary data  sources  are  Law  number  16  of  2019  concerning  Amendments  to  Law  number  1  of  1974  and  Pontianak  Religious  Court  decision  documents.  Secondary  data  sources  are  journals,  books,  Compilation  of  Islamic  Law  and  literature  related  to  marriage  dispensation.   The  results  of  this  study  state  The  Panel  of  Judges  granted  the  application  for  marriage  dispensation  based  on  the  provisions  of  Article  7  of  the  Marriage  Law. Not only that,  the  Panel  of  Judges  also  adhered  to  the  ushul  fiqh  principle  “preventing  harm  is  more  important  than  bringing  benefit”  in  deciding  this  case.  The judges explained  that  marriage,  which  is  an  act  of  worship  in  Islam,  is  also  protected  by  the  1945  Constitution  and  the  Child  Protection  Law.  The judge  considered  the  legal  facts  presented  by  the  applicant  as  the  basis  for  the  decision.  Based  on  these  facts,  the  judge  concluded  that  the  marriage  requested  was  urgent  given  that  the  relationship  between  the  prospective  bride  and  groom  was  already  very  close.  Concerns that a  religiously  prohibited  act  would  occur  if  the  marriage  was  not  immediately  solemnized  were  also  taken  into  consideration  by  the  judge.  In addition,  the  judge  also  considered  that  there  was  no  legal  impediment  for  the  prospective  bride  and  groom  to  marry  because  they  were  not  related  by  blood  or  consanguinity.
